Dump trucks on SR-52. Semis on the Suncoast.

Land O' Lakes truck accident lawyer

Land O' Lakes is being built out, and the trucks doing the building share US-41, SR-52 and SR-54 with everyone else. A truck crash is a different case from the first day, and Conde-Huggins treats it that way.

Drive SR-52 through Land O' Lakes on a weekday morning and count the dump trucks. The subdivisions going up between the Suncoast Parkway and US-41 run on fill dirt, aggregate, concrete and lumber, and all of it arrives by truck on a road the Pasco MPO already names as one of the county's fatal-crash corridors. Add the tractor-trailers using the Suncoast Parkway and US-41 to bypass Tampa, the delivery fleets serving the plazas on SR-54, and the county's own garbage trucks and buses, and Land O' Lakes has a truck problem that does not show up on a map.

Three truck crashes we see in Land O' Lakes

The construction hauler on SR-52 or Sunlake Boulevard. An overloaded dump truck takes a curve too fast, or follows too closely in the queue at Gowers Corner, or pulls out of a site entrance across traffic. These trucks are often owned by one company, driven for another and dispatched by a third, and the load ticket tells whether the truck was legal.

The tractor-trailer at the Suncoast ramps or on US-41. A semi that fails to slow for stopped traffic at the SR-54 signal east of exit 19, or a wide right turn at US-41 and SR-54 that sweeps a car in the next lane under the trailer. These carriers keep electronic records that answer most questions about the crash, if they are preserved.

The delivery or service truck in the plazas. Box trucks and vans backing out of loading areas on SR-54 and US-41, often driven by contractors rather than employees. The contractor label rarely decides who pays; the company whose name is on the truck usually answers for the driver.

If the vehicle was a GOPasco bus, a school bus or a county truck, Fla. Stat. § 768.28 governs: notice before suit, a six-month wait, and a $200,000 per-person cap.

The evidence that goes away

A car accident leaves a crash report and two damaged vehicles. A truck crash leaves a data trail that the carrier controls.

  • Hours-of-service logs from the electronic logging device. Carriers must keep them six months.
  • Engine control module data: speed, throttle, brake application and cruise control in the seconds before a hard stop. Overwritten when the truck returns to service.
  • Dash camera video, inward and outward facing, on a loop the carrier sets.
  • The driver qualification file, drug test results and inspection reports.
  • Dispatch records, bills of lading and weight tickets, which show whether the schedule was possible and the load was legal.

We send a spoliation letter to the carrier, its insurer and every owner in the chain within days of being retained. After that letter, destroying the evidence is something a Florida court can punish, including by telling the jury to assume the evidence was unfavorable. Before it, the carrier can lawfully let the records expire. Call (240) 421-5511 this week.

Florida law as it applies to a Land O' Lakes truck crash

PIP first. If you were in a passenger vehicle, your own PIP pays the first $10,000 at 80 percent, provided you were treated within 14 days (Fla. Stat. § 627.736). See a physician, not only a chiropractor, so the emergency medical condition finding is in the chart and the full $10,000 is available rather than $2,500.

The threshold. Pain and suffering requires a permanent injury under Fla. Stat. § 627.737(2). A truck crash at SR-52 speeds rarely leaves the question close, but the documentation still has to exist.

Fault. Fla. Stat. § 768.81(6) bars recovery for anyone more than 50 percent at fault. The carrier's standard defense is that the car cut in front of the truck or stopped short. The ECM and the forward-facing camera settle that, which is the other reason to preserve them.

Insurance. Interstate carriers hauling general freight carry at least $750,000 under federal rules; hazardous-materials carriers far more. Intrastate dump trucks and landscape trailers may carry much less, which is why your own UM/UIM coverage under Fla. Stat. § 627.727 is part of every truck case we handle.

Deadline. Two years from the crash under Fla. Stat. § 95.11(5)(a); two years for wrongful death under § 95.11(5)(e); and the separate notice requirement of § 768.28(6) when a government vehicle is involved.

Who investigates, and where the records are

FHP Troop C investigates most commercial vehicle crashes in unincorporated Pasco, including SR-52, SR-54, US-41 and the Suncoast Parkway, and its commercial vehicle enforcement troopers may inspect the truck and the driver's records at the scene. That inspection report is evidence, and we request it with the crash report. The Pasco Sheriff's Office may respond on local roads; its Public Records Unit is at 20105 Central Boulevard in Land O' Lakes. Crash reports are confidential for 60 days except to the parties and their attorneys under Fla. Stat. § 316.066(2).

How we build the case from Ridge Road

  1. Meet you at AdventHealth Wesley Chapel, BayCare, St. Joseph's Hospital-North, HCA Florida Bayonet Point or your home. Land O' Lakes has no hospital, so our clients are spread across all of them.
  2. Photograph the scene and both vehicles before the truck is repaired and your car is salvaged.
  3. Serve preservation demands on every company on the report and every company behind it.
  4. Obtain the FHP report, inspection report, 911 audio and camera footage from the businesses along the corridor.
  5. Identify every policy and every responsible party: driver, carrier, owner, contractor, broker, shipper.
  6. Wait for your doctors, then make the demand, and file at the West Pasco Judicial Center or the Robert D. Sumner Judicial Center if the carrier will not pay what the case is worth.

Clementine Conde is a Florida Bar member since 1992 and handles every truck case the firm takes. Questions people ask us about land o' lakes truck accident cases

A dump truck hauling fill for a subdivision on SR-52 rear-ended me. Who do I make a claim against?

Potentially several companies. The hauler that employs the driver, the owner of the truck if it is leased, the contractor or developer that set the schedule and the loading, and each of their insurers. Fill-dirt and aggregate haulers are often small intrastate operators with lower insurance limits than interstate carriers, so we also open a claim on your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727. The first step is a written preservation demand so the truck's records are not lost when it goes back to work the next morning.

Do federal trucking rules apply to a local truck that never leaves Pasco County?

Largely yes. Florida adopts the Federal Motor Carrier Safety Regulations for in-state commercial vehicles through Fla. Stat. § 316.302, so hours-of-service limits, inspection requirements and driver qualification rules apply to a Land O' Lakes dump truck as well as a Georgia tractor-trailer. The main difference is insurance: interstate general-freight carriers must carry at least $750,000 in liability coverage, while some intrastate operators carry far less.

Does my own PIP apply when a truck hit my car?

Yes. Your personal injury protection pays 80 percent of medical bills and 60 percent of lost income up to $10,000 regardless of fault, provided you got initial care within 14 days of the crash (Fla. Stat. § 627.736). The claim against the trucking company and its insurer covers the rest, and to recover pain and suffering you must meet the permanent-injury threshold in Fla. Stat. § 627.737(2). Truck crash injuries usually do, but a physician has to say so in the records.

What if the truck belonged to Pasco County or was a GOPasco bus?

The claim is governed by Florida's sovereign immunity statute, Fla. Stat. § 768.28. You must give written notice to the county, and for most agencies to the Department of Financial Services as well, and wait for a denial or six months before filing suit. Recovery is capped at $200,000 per person and $300,000 per incident unless the Legislature passes a claims bill. These cases are winnable but unforgiving on procedure, so call early.

How long do I have to sue after a Land O' Lakes truck crash?

Two years from the crash under Fla. Stat. § 95.11(5)(a), and two years for wrongful death under § 95.11(5)(e). The more urgent deadline is the carrier's: federal rules require hours-of-service records to be kept for only six months, and engine data can be overwritten as soon as the truck is repaired. Call (240) 421-5511 in the first week, not the second year.
