The Florida Wrongful Death Act says its purpose plainly: to shift the losses caused by a wrongful death from the survivors to the wrongdoer. For a Land O' Lakes family that usually means a crash on SR-52 near Gowers Corner, on US-41, on SR-54 at the plazas or on the Suncoast Parkway, a trooper at the door, and then a stack of decisions no one is prepared to make.

Conde-Huggins Accident Injury Lawyers makes those decisions with you and carries the work. We meet families at home anywhere in Land O' Lakes, and there is no attorney's fee unless we recover compensation. Call (240) 421-5511 when you are ready, and not before.

The roads, and what they mean for the case

SR-52. The Pasco Metropolitan Planning Organization has singled out SR-52 near Land O' Lakes as a corridor where the county's fatal crashes concentrate, and FDOT is planning to widen it and rebuild Gowers Corner because of how it functions. Fatal crashes here are often head-on or lane-departure collisions at highway speed involving commercial trucks, which changes who the defendants are.

US-41. Land O' Lakes Boulevard mixes highway speeds with driveways and median openings. Left-turn collisions and pedestrian deaths are the pattern.

SR-54 and the Suncoast Parkway. High-speed, multi-vehicle crashes with drivers from Hernando, Hillsborough and beyond, which complicates the insurance picture from day one.

Countywide, the MPO reported an average of roughly 103 traffic deaths a year from 2018 through 2022, and a fatality rate about 30 percent above Florida's. Behind every number is a family that now has to deal with the law.

What the Act does, and who it does it for

A wrongful death claim is a civil case under Fla. Stat. §§ 768.16–768.26. It is separate from any criminal charge the State Attorney may bring against the other driver, and it does not wait for the criminal case to end.

One claim, one filer. The personal representative of the estate brings the action on behalf of every survivor and the estate (§ 768.20). Family members do not file their own suits. If there is no will, the probate court in Pasco County appoints the personal representative, usually the surviving spouse or a person chosen by a majority of the heirs. We help open the estate at the same time we start the investigation.

Who counts as a survivor. Section 768.18(1) lists the spouse, the children, the parents and, when they were partly or wholly dependent on the decedent for support or services, blood relatives and adoptive brothers and sisters. Section 768.18(2) defines "minor children" as children under 25.

What each survivor recovers under § 768.21.

  • Every survivor: lost support and services, past and future.
  • The spouse: loss of companionship and protection, and mental pain and suffering.
  • Minor children, and all children when there is no surviving spouse: lost parental companionship, instruction and guidance, and mental pain and suffering.
  • Each parent of a deceased minor child: mental pain and suffering. Each parent of a deceased adult child: the same, but only if there are no other survivors.
  • The estate: lost earnings from injury to death, lost net accumulations where the statute allows, and medical and funeral expenses.

Section 768.21(8) also contains a harsh limit: when the death results from medical negligence, adult children and the parents of an adult child may not recover non-economic damages. A repeal passed the Legislature in 2025 and was vetoed; a new bill was filed for 2026. If a hospital's care is part of your family's story, ask us where that law stands.

The insurance that actually pays

Compensation comes almost entirely from insurance, and in Florida that requires looking past the other driver's policy.

  • PIP death benefit. The decedent's own auto policy pays $5,000 under Fla. Stat. § 627.736(1), in addition to the medical benefits used before death.
  • UM/UIM. Uninsured/underinsured motorist coverage under § 627.727 on the decedent's policy or a household member's. Because Florida does not require bodily injury liability coverage, this is often the main source of recovery.
  • Commercial policies. A dump truck on SR-52 or a tractor-trailer on the Suncoast Parkway brings in a carrier, an owner and limits far above a private policy. See our Land O' Lakes truck accident page.
  • Government vehicles. A GOPasco bus, a county truck or a school bus means Fla. Stat. § 768.28: written notice within two years, a 90-day wait, and a cap of $200,000 per person and $300,000 per incident.
  • Comparative fault. Under § 768.81(6), if the person who died is found more than 50 percent at fault the survivors recover nothing from the other driver. Insurers press this hardest when the one person who could answer is gone. Reconstruction evidence is the family's answer.
  • Bars and restaurants. Fla. Stat. § 768.125 allows a claim only for willfully serving someone underage or knowingly serving a person habitually addicted to alcohol. Most impaired-driving deaths are pursued against the driver and the family's UM coverage.

An adjuster may call your family within days with a check and a release. The release ends every survivor's claim. Call (240) 421-5511 before you sign anything, and let us take those calls from then on.

Who investigates a fatal Land O' Lakes crash

The Florida Highway Patrol, Troop C, handles nearly every fatal crash in unincorporated Pasco, including SR-52, US-41, SR-54 and the parkway. Its traffic homicide investigators take months to reconstruct the crash and produce a file far deeper than a standard report. Cause of death is determined by the District Six Medical Examiner, which serves Pasco and Pinellas counties. We obtain the homicide report, the 911 recordings, the medical examiner's findings and the vehicle data, and we send preservation demands for the vehicles and any camera footage in the first week, because that evidence does not wait for the trooper's report.

What we do, and where

Conde-Huggins meets your family at home in Land O' Lakes, explains the process once in plain language, opens the estate in Pasco County, documents every survivor's losses under § 768.21 with an economist where lost support requires one, presents the claim to every insurer and files at the West Pasco Judicial Center in New Port Richey or the Robert D. Sumner Judicial Center in Dade City when the offers do not reflect the loss. Clementine Conde, a Florida Bar member since 1992 with decades of trial experience in Pasco courts, handles each case personally.

Questions people ask us about land o' lakes wrongful death cases

My husband was killed on SR-52 and the trooper says the investigation will take months. What should I be doing now?

Three things, and we do all of them for you. First, preserve evidence: the vehicles, any dash or business camera footage, and the names of witnesses. Second, open the estate in Pasco County so a personal representative can be appointed; the claim cannot be filed without one. Third, say nothing to the other driver's insurer and sign nothing. The FHP traffic homicide report will arrive when it arrives, and it will strengthen a case that was already built.

Our daughter was 24 and living on her own. Are we still her 'parents' under the wrongful death law?

Yes, and the distinction matters. The Florida Wrongful Death Act defines 'minor children' as children under 25 (Fla. Stat. § 768.18(2)), so the parents of a 24-year-old are the parents of a minor child and may each recover for their mental pain and suffering under § 768.21(4). The parents of a child 25 or older recover for mental pain and suffering only if there are no other survivors. The estate separately recovers medical and funeral expenses.

The other driver had only a minimum policy. Is there anything else?

Usually. Florida does not require bodily injury coverage at all, so we assume from the start that the other driver's policy will not be enough. We look at uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 on your family member's own policy and on the policies of relatives in the household, at the $5,000 PIP death benefit under § 627.736(1), at any umbrella policy, and at whether the other driver was working, which brings in an employer and a commercial policy.

Can we recover for the pain our mother suffered before she died at the hospital?

Not as part of a Florida wrongful death claim. Under Fla. Stat. § 768.20, when a personal injury results in death, the injured person's own claim does not survive; the survivors' claim takes its place. What the law compensates is your family's loss: lost support and services, companionship, guidance and your own mental pain and suffering, each as § 768.21 defines it for your category of survivor, plus the medical and funeral expenses the death caused.

How long does a Land O' Lakes family have to act?

Two years from the date of death under Fla. Stat. § 95.11(5)(e). If a county vehicle, a GOPasco bus or a school bus was involved, written notice under § 768.28(6) must also be presented within two years, followed by a 90-day wait before suit, and recovery is capped at $200,000 per person. Appointing a personal representative and completing the investigation take time, so we ask families to call well before the deadline.
