Someone in your family left the house in Port Richey and did not come back. A trooper came to the door, or the call came from HCA Florida Bayonet Point, and since then the days have been funeral arrangements, relatives, and a growing stack of mail from insurance companies.

This page explains what Florida law does for a family in that position and how Conde-Huggins Accident Injury Lawyers, at 6609 Ridge Road, Suite 4, handles the legal work. We meet families at home anywhere in Port Richey or Pasco County. The consultation is free and private, and there is no attorney's fee unless we recover compensation. After a fatal crash in Port Richey: who does what

A death on US-19 or Ridge Road involves several agencies, and knowing which one holds what helps a family understand the months ahead.

The investigation. On US-19 and in the unincorporated neighborhoods of Jasmine Estates, Embassy Hills and Bayonet Point, the Florida Highway Patrol's Troop C conducts the traffic homicide investigation. Inside the city limits, the Port Richey Police Department at 6333 Ridge Road handles it. A homicide investigation is far more detailed than an ordinary crash report: reconstruction of speeds and angles, vehicle inspections, toxicology, witness interviews. It can take months to close.

The medical examiner. Pasco County deaths are handled by the District Six Medical Examiner's Office in Largo, which serves Pasco and Pinellas counties. The autopsy report and toxicology results come from there, and they matter in the civil case because insurers use them to argue the decedent's own fault.

The hospital. When death follows a hospitalization at Bayonet Point or Morton Plant North Bay, the hospital's billing office will pursue the estate for the bill and may assert a lien. Those bills are part of the claim, and we handle the billing office so the family does not.

The insurers. Within days, the at-fault driver's insurer and sometimes your own will call. They are not required to explain the law to you. We are.

Who may bring the claim, and who is a survivor

Florida's Wrongful Death Act, Fla. Stat. §§ 768.16–768.26, does not let each family member sue separately. Under § 768.20, the personal representative of the estate brings one action for all of the survivors and the estate. If no estate has been opened, we help the family open one in the circuit court in Pasco County so the claim can proceed.

The Act defines survivors in § 768.18(1): the decedent's spouse, children, parents, and any blood relative or adoptive sibling who depended on the decedent for support or services. "Minor children" under § 768.18(2) means children under 25.

What each survivor may recover is set out in § 768.21:

  • Every survivor may recover lost support and services, past and future.
  • The spouse may also recover for lost companionship and protection and for mental pain and suffering.
  • Minor children, and all children if there is no surviving spouse, may recover for lost parental companionship, instruction and guidance, and for mental pain and suffering.
  • Each parent of a deceased minor child may recover for mental pain and suffering; a parent of an adult child may do so only if there are no other survivors.
  • The estate recovers lost earnings from injury to death, lost prospective net accumulations where the statute allows, and medical and funeral expenses charged to the estate.

A family in Port Richey often includes a spouse of many years and adult children living elsewhere. Which of them may recover for their grief depends on these categories, and we go through them one by one in the first meeting. Call (240) 421-5511.

Insurance in a Port Richey death case

Nearly every dollar in a wrongful death case comes from insurance, so the policies decide what is possible.

Florida does not require bodily injury liability coverage on private vehicles. A driver on US-19 who caused a death may carry the $10,000 PIP and $10,000 property damage minimum and nothing else. The decedent's own PIP pays a $5,000 death benefit under Fla. Stat. § 627.736(1). After that, the family's own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727, on the decedent's policy or a household member's, is often the primary source of recovery. We review every declarations page in the family.

When the at-fault driver was working, driving a company vehicle, or logged in to a rideshare app, commercial and umbrella policies with higher limits apply. A rideshare driver on a trip carries at least $1 million in coverage under Fla. Stat. § 627.748(7). When the vehicle belonged to Pasco County, a city or the school board, Fla. Stat. § 768.28 caps recovery at $200,000 per person and $300,000 per incident and requires written notice within two years of the death.

Fault matters here too. Under Fla. Stat. § 768.81(6), if the decedent is found more than 50 percent responsible, the survivors recover nothing from the other driver. Insurers argue fault hardest when the one person who could answer is gone. The reconstruction evidence, the vehicle data and the witnesses answer for them, and we gather it before it is lost.

Two years, and the exceptions that run faster

A Florida wrongful death action must be filed within two years of the date of death under Fla. Stat. § 95.11(5)(e). That limit covers the probate appointment, the investigation and the preparation of the case, so it is tighter than it sounds. A claim against a government body requires written notice within the same two years under § 768.28(6), and suit cannot be filed until the agency denies the claim or 90 days pass.

Evidence has its own deadlines. The vehicles are salvaged within weeks. Plaza and gas station cameras along US-19 overwrite in days. The driver two cars back moves away. We send preservation letters in the first week after a family retains us, which is why we encourage families to call before they feel ready to think about any of this.

How Conde-Huggins works with Port Richey families

  • We meet at your home, on your schedule, and explain the process once, in plain terms.
  • We obtain the FHP or Port Richey PD homicide file, the medical examiner's report, 911 audio and hospital records, and we preserve the vehicles and video.
  • We help open the estate and have a personal representative appointed in Pasco County.
  • We identify every survivor and document each person's loss, with testimony from family, employers and, where needed, an economist.
  • We find every policy, present the claim to each insurer, and file at the West Pasco Judicial Center on Little Road when the offers do not reflect the loss.

Clementine Conde, a Florida Bar member since 1992 with decades of trial experience in Pasco and Pinellas courts, handles every case personally. Our countywide wrongful death page explains the Act in more detail, our Port Richey page covers the other claims we handle in the city, and our Hudson wrongful death page addresses deaths at Bayonet Point hospital and on the US-19 corridor north of SR-52. If the crash involved a commercial truck, see our Port Richey truck accident page.

Questions people ask us about wrongful death cases

My husband died at Bayonet Point two days after a crash on US-19 in Port Richey. Is that still a wrongful death case?

Yes. The Florida Wrongful Death Act, Fla. Stat. §§ 768.16–768.26, applies whenever a death is caused by another person's negligence or wrongful act, whether death occurred at the scene or days later in the hospital. The medical bills from those two days become part of the claim, along with funeral expenses, and the two-year filing deadline under Fla. Stat. § 95.11(5)(e) runs from the date of death. The estate's personal representative brings the claim on behalf of you and any other survivors.

Who gets the FHP traffic homicide report, and how long does it take?

FHP Troop C's traffic homicide investigators handle fatal crashes on US-19 and in unincorporated Pasco, and the Port Richey Police Department handles fatal crashes inside the city limits. A homicide investigation can take months, because it includes reconstruction, toxicology and vehicle inspections. The standard crash report is available much sooner through the Florida Crash Portal, restricted for 60 days to the parties, their attorneys and insurers under Fla. Stat. § 316.066(2). We obtain both, and we do not wait for the homicide report to start preserving evidence.

The other driver's insurer called the day after the funeral with an offer. What should I do?

Do not sign anything. A wrongful death release ends the claim for every survivor, not only the person who signs it, and an offer made before the investigation is complete is priced on what the insurer hopes the case is worth, not what it is. Refer the adjuster to us. We identify every survivor under Fla. Stat. § 768.18, document each person's losses under § 768.21, and locate every policy before anyone discusses a number.

Does the estate have to be opened in Pasco County before a claim can start?

A personal representative must be appointed by the circuit court before a wrongful death suit is filed, and for a Port Richey resident that probate proceeding is in Pasco County. The investigation does not wait for the appointment. We send preservation letters, obtain the crash file and notify insurers while the probate filing is pending, and we coordinate the probate so the two move together. If there is no will, Florida law sets an order of preference for who may serve.

Can a family recover anything if the driver who caused the death had only the Florida minimum insurance?

Often, yes. Florida requires only PIP and property damage liability, so the at-fault driver may have no bodily injury coverage at all. The decedent's own PIP pays a $5,000 death benefit under Fla. Stat. § 627.736(1). Beyond that, uninsured/underinsured motorist coverage on the decedent's policy or a household member's policy under Fla. Stat. § 627.727 is frequently the main source of recovery, and a commercial, rideshare or umbrella policy applies when the at-fault driver was working or driving for Uber or Lyft.
